► Design Work This covers all aspects of design, including concept, graphics, illustration and typography, related, but not limited to, website, logo, business card, letterhead, leaflet and/or poster design created by Applebox Designs. ◢ Copyright Retained by Applebox Designs For my part I will not duplicate any work produced for you in any other Applebox Designs commission. For your part you agree not to infringe Applebox Designs’ copyright by utilising any of the design work for this contract without prior written permission. ◢ Copyright Not Retained by Applebox Designs For my part I acknowledge that you retain the copyright on all your artwork / design concepts and I undertake not to utilise any of said material supplied by you for this contract in any other Applebox Designs commission. For your part you acknowledge that, unless specified as part of the contract, Applebox Designs retains overall editorial control of all design work. |
► Site Hosting & Domain Name Registration ◢ Hosting & Registration arranged by Applebox Designs If you have contracted for Applebox Designs to arrange Site Hosting and/or Domain Name Registration on your behalf you accept that Applebox Designs is unable to transfer control to you until the expiry of the specified initial (or renewed) contract period. For my part I will give four weeks notice of Site Hosting and/or Domain Name Registration contract renewal date(s) and applicable fees. If payment is not received by the due date the contract(s) will not be renewed and the Site Hosting and/or Domain Name Registration will lapse. In such an event, Applebox Designs will accept no responsibility for subsequent loss of Domain Name Registration. For your part you undertake to give a minimum of four weeks notice of cancellation of Site Hosting and/or Domain Name Registration during the term of the contract. Fees paid on your behalf by Applebox Designs are not refundable. ◢ Hosting & Registration arranged by Client You remain responsible for renewal of any contracts with your service providers that are required to maintain a continued web presence. |
► Site Maintenance The initial contract with Applebox Designs will specify whether control of site maintenance resides with Applebox Designs or the Client. Applebox Designs is always willing to consider a subsequent transfer of control of site maintenance from the Client to Applebox Designs during the contract period. However, at present, unless such an agreement forms part of the contract, Applebox Designs cannot arrange transfer of control of site maintenance from Applebox Designs to the Client during the contract period. ◢ Sites Maintained by Applebox Designs For my part I undertake, on payment of the Maintenance Fee, to fulfill for the period of the contract an unlimited number of updates to the contracted site design. For your part you accept that Applebox Designs retains permanent control of the site maintenance. ◢ Sites Maintained by the Client For your part, if as part of the initial contract, you have negotiated with Applebox Designs to undertake your own site maintenance, changes to the site are restricted to content only and you agree to make no changes to the overall design. |

► Payment All invoices are to be paid within 30 days of the invoice date. Applebox Designs accepts payment in the form of cheques or through PayPal (please note, if the client requests a PayPal invoice, additional PayPal fees will incur in accordance with PPCalc). |
If full payment has not been received within 30 days, it is the statutory right of Applebox Designs to claim interest on the total costs in accordance with the Late Payment Legislation. Continued failure to pay could result in further action which includes but is not limited to contract termination or suspension of website account. |
